Terms of Service

1. Who you are contracting with

DoneVid is operated by NexusGrowth LLC, a company formed in Delaware, United States. By creating an account or using DoneVid you accept these terms. If you do not accept them, do not use the service.

If you are using DoneVid on behalf of an organisation, you confirm that you are authorised to accept these terms for it, and “you” means that organisation.

2. What DoneVid is

DoneVid is a hosted software service: a web workspace in which you describe an image or a video in writing, choose an AI model, and run a generation. The result is produced by third-party AI models that we call through their providers. DoneVid is sold as a subscription with a monthly allowance of Credits, and Credits are the unit in which usage is measured.

The models available in the workspace, and the settings each one exposes, change as providers add, update and retire them. We do not promise that any particular model will remain available.

3. Your account

You need an account to generate anything. You must give accurate registration details, keep your sign-in credentials secure, and you are responsible for what happens under your account. Accounts are for a single user; do not share your credentials.

You must be old enough to enter a binding contract where you live, and at least 18 years old.

4. Subscriptions and billing

Plans are shown with their price and their monthly Credit allowance before you buy. All prices are in US dollars (USD) and, unless stated otherwise at the point of sale, exclude any taxes that apply where you are.

• Monthly plans are charged each month and renew automatically until you cancel.
• Annual plans are charged once, upfront, for the whole year. The Credits are not delivered in one lump: an annual plan releases its Credits in 12 monthly releases across the paid term.
• Credit Packs are one-time purchases of additional Credits for accounts that already hold an eligible active subscription. A Pack is not a subscription and does not renew.

Payments are processed by our payment processor. We do not receive or store your full card details.

Changing plans. An upgrade, a downgrade or a change of capacity takes effect at your next renewal, and changes are not prorated within a period you have already paid for.

5. Credits

A Credit is a usage unit for DoneVid AI generation services. It is not money, not a currency, not a token, and not a stored cash balance. Specifically:

• Credits can only be used inside DoneVid, for DoneVid generation services.
• Credits are not transferable between users or accounts.
• Credits are not redeemable for cash and have no value outside DoneVid.
• Different tasks and different models consume different numbers of Credits. The cost of a run is shown in the workspace before you start it.
• Credits included with a plan are released for that month and do not carry over into the next month. Credits bought in a Credit Pack do not expire while your account is open.

None of this removes your right to a refund of a purchase where our Refund and Cancellation Policy or the law gives you one.

6. Refunds and cancellation

• Cancellation. You can cancel a subscription at any time. Cancelling stops the next renewal; it does not end the term you have already paid for. Through the rest of a paid term you keep your access and, on an annual plan, you keep receiving the monthly Credit releases that belong to that term.
• Subscription refunds. A refund can be requested within 7 days of your initial purchase, and is available where the paid entitlement is entirely unused.
• Credit Pack refunds. A Pack can be refunded within 7 days of purchase if the entire Pack is unused.
• Failed generations. If a generation fails because of a system error on our side, its Credits are restored to your balance automatically. You do not need to ask.
• Results you do not like. AI output is variable by nature. Not being satisfied with a result is not, on its own, grounds for an automatic refund — but tell us anyway, because a bad result is often a fault we can fix or restore Credits for.
• Your legal rights come first. Where consumer law where you live gives you a stronger right to cancel or to a refund, that law applies and overrides this policy.

7. Acceptable use

Your use of DoneVid must follow the Acceptable Use Policy, which forms part of these terms. It prohibits, among other things, illegal content, child sexual exploitation of any kind, non-consensual and sexually explicit imagery of real people, fraud and deception, malicious software, and content that infringes other people’s copyright, trademark or similar rights.

We may remove content and suspend or close accounts that breach that policy, and we may report unlawful activity to the authorities.

8. Your content and your rights

You keep whatever rights you have in the prompts and files you supply and, as between you and us, in the output you generate. You are responsible for having the rights to what you upload, and for how you use what you generate.

You grant us the limited licence we need to operate the service: to store your inputs and outputs, to transmit them to the AI provider that runs your generation, and to display them back to you. We do not use your prompts or your generated work to advertise DoneVid without your permission.

AI models can produce similar results for different users. We therefore cannot promise your output is unique, and we make no promise about whether AI-generated work can be protected by copyright in your country.

9. Availability and changes

We aim to keep DoneVid available, but it is not guaranteed to be uninterrupted or error-free. We may change, add or withdraw features, including individual models, and we may impose reasonable limits to protect the service against abuse.

We may update these terms. If a change is material we will give notice on the site before it takes effect, and the change will not apply retroactively to a term you have already paid for.

10. Disclaimers and liability

To the extent the law allows, DoneVid is provided “as is”. We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing here excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.

To the extent the law allows, our total liability arising out of or relating to the service in any twelve-month period is limited to the amount you paid us for the service in that period.

11. Suspension and termination

You can stop using DoneVid at any time and close your account. We may suspend or close an account that breaches these terms or the Acceptable Use Policy, that is being used unlawfully, or where we are required to do so by law. Where we close an account for our own convenience rather than for a breach, we will refund the unused part of a prepaid term.

12. Governing law

These terms are governed by the laws of Delaware, United States, without regard to conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction. This does not deprive you of the protection of mandatory consumer law in the country where you live.
